ITOC Pty Ltd Privacy Policy
ITOC Pty Ltd is subject to the Privacy Act and the associated National Privacy Principles. This policy sets out how the company collects, holds and uses personal information collected from individuals in the conduct of our business. ITOC Pty Ltd may be referred to as “ITOC” or “The Company” in this document.
1.0 Protecting Personal Information
All personal information collected from individuals as a result of our business operations will be protected as an essential part of the relationship we wish to establish with our clients. The company will only disclose this information in accordance with the provisions of the Privacy Act and the National Privacy Principles.
We gather Personal Information from a variety of places, including your registration and order forms, e-mails and surveys. Please be aware that partners, resellers, clients and agents of ITOC, as well as websites that have links to our site, may also collect your personal information. What other organisations and/or websites do with this information is governed by their privacy policy – not this privacy policy. – You are encouraged to review the privacy policy on any website you visit.
2.0 Information That the Company Holds
In the normal course of business activities, the company will collect personal information, including sensitive information. Personal information may include an individual's name, company name, address, contact details, ABN, ACN. Sensitive information may include the individual’s credit card number and charge details.
3.0 Website Tracking - Data Collected
ITOC measures and analyses its internet usage to ensure the site meets its objectives with its users. Individual privacy is protected but ITOC’s partners gains insights on how make the site more useful for the client and marketplace through monitoring:
- The number of page views (or page impressions) that occur on an ITOC site;
- The number of unique visitors;
- How long these unique visitors (on average) spend on an ITOC site; and
- Common entry and exit points to ITOC’s sites.
- Other Technical information such as IP Addresses, Computer Operating Systems, Web Browser Types, etc… may be recorded for quality assurance purposes.
Data collected by ITOC is anonymous information that does not personally identify you but is helpful for marketing purposes or for improving a visitor’s experience on the site.
3.1 Website Tracking - User Information Collected
ITOC uses the Personal Information it gathers to assist us with providing you the best online experience possible. We use Contact Data to send information about our company and services, or promotional material from some of our partners, or to contact you when necessary about the services we provide you. We reserve the right, in our sole discretion, to send bulletins and other important information to you. We may use your Financial Data to verify your qualifications for certain services and to bill you for services. We may also use your Demographic Data to gather general interest in our services, to help in the analysis of service usage, purchasing and target markets.
3.2 Website Tracking – Community Sites
Please note that any information you post to a public bulletin board, blog, (such as the ITOC Community, or Cloud Blog), chat, community help, wikis, technology-guides, personal sharing URLs (such as your_unique_name_here.community.itoc.com.au) and user profiles (the "Community Sites") is publicly available to all people and/or devices accessing that location. Your e-mail address and other personal information or content you upload may also be posted on these Community Sites. The information you share, including your email address, would then be available to all people and/or devices accessing these Community Sites, and such information may be read, collected or used by others for any purpose, including sending you unsolicited messages. ITOC is not responsible for any information you elect to submit in these Community Sites or the use of such information. In addition, you should be aware that some Community Sites offer a service in which subscribers are e-mailed a copy of all messages posted to the Community Sites on a particular topic. Consequently, if you post a message to such Community Sites, your e-mail address will be sent to those subscribers who have indicated an interest in the topic of your message. If you do not wish for your personal information to be posted or distributed in this manner, you should not participate in the Community Sites.
3.3 Website Tracking - Cookies
ITOC uses "cookies" in providing services and to enhance your experience on the site. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to enable our systems to recognise your browser in order to do a number of things, including but not limited to, customise content specific to your interests, ensure that you do not see the same advertisement repeatedly and to store your password so you do not have to re-enter it each time you visit the Site. The "help" portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. However, cookies allow you to take full advantage of ITOC site and services.
4.0 Use and Disclosure of Personal Information
ITOC may use personal information to:
- Provide its services, particularly those associated with IT consulting and development.
- Advise on solutions it can offer
- Manage its internal business operations
ITOC will only disclose information for the purpose of which it was collected, and where appropriate, after obtaining the necessary consent from the individual. Information may be disclosed for other purposes, with the specific consent of the individual to do so.
The company may also be required to disclose personal information where the law requires such disclosure.
5.0 Sharing of Personal Information
ITOC uses Personal Information primarily for our own internal purposes, such as providing, maintaining, evaluating, and improving our Services and the Website, fulfilling requests for information, producing and shipping the products that you order, and providing customer support. Your personal information will not be shared with third party vendors, advertisers or data collectors.
6.0 User Choice Regarding Collection, Use and Distribution of Personal Information
You may choose not to provide us with any Personal Information. In such an event, you can still access and use some of the site; however you will not be able to access and use those portions of the site that require your Personal Information and you will not be able to purchase services from us. If you do not want us to share your Contact Data with any third parties, please change your settings in the Support section of our site. However, users may not "opt out" of receiving information from ITOC which is related to maintaining or updating client accounts and system information or our release of contact data pursuant to court orders or criminal investigations.
7.0 Confidentiality and Security of Personal Information
ITOC will take reasonable steps to ensure the security of personal information that it holds, regardless of the form in which that information is held. This will include taking reasonable steps to prevent the misuse or loss of this information, or unauthorised disclosure, access to, or modification of this information. ITOC ensures its best efforts to keep your Personal Information private, however where necessary, information may be disclosed to: (a) protect our rights or property; or (b) enforce this Privacy Policy or any agreement between you and ITOC.
Where the information is held in electronic form, access will be controlled by user logins and passwords, and restriction of access only to persons who need to have that access in the course of the company's business activities. Your Personal Information is stored on servers that are generally not accessible by third parties and a minimal number of our employees have access to your Personal Information. All Financial Data is transmitted using ITOC’s PCI Compliant Secure Proprietary Technologies within the company and SSL (Secure Sockets Layer) via the web, encrypting your information before completing any transactions.

INHERENT IN THE USE OF THE INTERNET AND INTERNET-RELATED TECHNOLOGIES IS SOME RISK OF DISCLOSURE OF INFORMATION, INCLUDING WITHOUT LIMITATION, PERSONAL INFORMATION YOU SUPPLY. YOUR USE OF THE SITE AND YOUR ENTRY OF INFORMATION IS AT YOUR OWN RISK. ITOC DOES NOT ACCEPT RESPONSIBILITY AND EXPRESSLY DISCLAIMS ALL LIABILITY FOR DAMAGE OR INJURY THAT YOU MAY INCUR OR THAT MAY RESULT FROM YOUR USE OF THE SITE OR THE INTERCEPTION OF INFORMATION YOU PROVIDE, INCLUDING WITHOUT LIMITATION, PERSONAL INFORMATION, BY A THIRD PARTY.
All staff of ITOC are subject to confidentiality obligations as part of their conditions of employment.
8.0 Right of Access by the Individual
Any individual has the right to request access at any time to the personal information that the company holds about that person. This access will be refused where the company cannot be satisfied as to the identity of the person requesting that access.
Any individual can request the company to modify or correct personal information that the person believes to be incorrect.The company can refuse to provide access to personal information where the Privacy Act allows it to do so.
To access your personal information you may view your profile in the Support section of the ITOC website. Through your profile you may:
(a) review and update your Personal Information that we have already collected;
(b) choose whether or not you wish us to send you information about our company or promotional material from some of our partners; or
(c) choose whether or not you wish us to share some of your Personal Information with third parties.
Where a request is limited to access to an individual's personal information, the company will take all reasonable steps to respond within five (5) working days of the receipt of the request. These steps will include verification of the identity of the individual concerned.
Where the request is in respect of correction of inaccuracies to an individual's personal information, the nature of the inaccuracy must be clearly stated, along with the information required to be entered in lieu of the inaccurate information. The company will take all reasonable steps to respond within five (5) working days of the receipt of the request. These steps will include verification of the identity of the individual concerned.
All requests for access to personal information (for whatever purpose) will be responded to in writing, and will be recorded in a register maintained for this purpose.
Where the individual's identity cannot be verified to the satisfaction of the Company Secretary, the request for access will be denied.

9.0 Use of the ITOC Website
The site is owned and operated by ITOC. No materials found on the site or any other site owned, operated, or licensed by ITOC may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way except as expressly provided by ITOC. You may not distribute, modify, transmit, reuse, repost or use the content of the site without ITOC prior permission. ITOC neither warrants nor represents that your use of materials displayed on the site will not infringe rights of any third party. Because of the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content, including all laws, rules, codes and regulations of the country in which you reside.
10.0 Links to Third Party Websites
Use of links provided in the site to websites not owned, maintained or hosted by ITOC ("Off-Sites"), will leave the ITOC website. ITOC is not responsible for any off-site's privacy policies or terms of use. No warranty is made with respect to the accuracy, timeliness, or suitability of the content of any off-sites, and ITOC takes no responsibility for such sites. A link to an off-site is not an endorsement of the off-site, its content, or its sponsoring organisation.
11.0 Limitation of Liability
Under no circumstances, including but not limited to negligence by act or omission, shall ITOC or any party involved in creating, producing, or delivering the site or its content, be liable for any direct, incidental, consequential, indirect or punitive damages that result from the use of, or the inability to use the materials on the site, even if ITOC or a representative authorised by ITOC has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event, however, shall ITOC 's total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the site.
12.0 Copyright complaints
ITOC may, in appropriate circumstances and at its sole discretion, terminate use of the site by any visitors who infringe on the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide ITOC Copyright Agent the following information:
- An electronic or physical signature of the person authorised to act on behalf of the owner of the copyright interest;
- A description of the copyrighted work that you claim has been infringed;
- A description of where the material that you claim is infringing is located on the site;
- Your address, telephone number, and email address;
- A statement by you that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent or the law; and
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner's behalf
